ParcelShield, LLC (“ParcelShield,” “we,” “us,” or “our”) values our relationship with you and takes your privacy seriously. The purpose of this online privacy policy (“Privacy Policy”) is to identify how we may process, collect, store, disclose, and use the data we collect from customers and end users (“User,” “you,” or “your”), including in connection with our website and package tracking, monitoring, and recovery services, which are made available via our websites parcelshield.com, monitormypacakges.com, and any other website controlled by ParcelShield that posts this Privacy Policy (the “Services”).  ParcelShield and our affiliates value and respect your right to privacy and confidentiality, and we recognize the importance of protecting information collected about our customers and end users. The purpose of this Privacy Policy is to describe in detail the privacy practices that apply for your use of the Services. This Privacy Policy also describes the choices you can make about our use of your information.

We may update or modify this Privacy Policy at any time by posting the amended version, including the effective date of the updated version. Please review this Privacy Policy periodically for any updates or changes. If, at any time, we decide to disclose or use your Personally Identifiable Information (as defined below) in a method different from that specified at the time it was collected, we will provide advance notice by email (sent to the email address held on file, if any). We will announce any material changes to this Privacy Policy by posting the amended version on our website. This Privacy Policy is binding on all those who access, visit, and/or use our Services, whether acting as an individual or on behalf of an entity, including you and all persons, entities, or digital engines of any kind that harvest, crawl, index, scrape, spider, or mine digital content by an automated or manual process or otherwise. Your continued use of the Services is considered your acceptance of these terms, and you agree to the collection and use of information in accordance with this Privacy Policy. Additionally, if you have any questions or concerns about our use of your Personally Identifiable Information, please do not hesitate to contact us through any of the methods below.

      2. INFORMATION WE COLLECT

      Our Privacy Policy covers the Personally Identifiable Information (or “PII”) that we may collect from you, how your information is used, how we may disclose your PII, and your rights and options regarding your PII. ”Personally Identifiable Information” or “PII” is information that identifies, relates to, describes, can reasonably be associated with, or can reasonably be linked to a particular individual or household without extraordinary effort. Personally Identifiable Information may include information such as your name, address, phone number, and other related information that you provide to us.

      This Privacy Policy also covers the Non-Personal Information that we may collect from you. “Non-Personal Information” or “NPI” means information that is in no way personally identifiable and that is obtained automatically when you access or use our Services.

      a. The Information We Collect About You

      We may collect the following categories of Personally Identifiable Information from you, depending on your interactions with the Services and the choices you make, as further described below:

      • Identifiers: Your name, mailing address, email address, phone number, unique personal identifier, and Internet Protocol (IP) address.
      • Financial Information: Your name, billing address, and payment information (including credit or debit card number and type, and expiration date).
      • Interactions: Records of services purchased, obtained, or other purchasing or consuming histories (including package information).
      • Professional or Employment-Related Information: Your company and your job title.
      • User Data: Any data entered voluntarily into a contact form on the Services.
      • Internet or other electronic network activity information:
        • Browse history. Data about the webpages you visit.
        • Search history. Data about the search terms you enter.
        • Device, connectivity, and configuration data. Data about your device and nearby networks, including regional and language settings.
      • Geolocation data: Data about your device’s location, which may be inferred from your IP address.
      • Inferences: Inferences drawn from any of the information identified above to create a profile about a consumer.

      b. When and How We Collect Your Information

      Most of the Personally Identifiable Information we receive relates to your use of and receipt of our Services, either as part of performing your job duties for your employer or employing organization, which has subscribed to the Services, or on your own behalf.

      We collect information from you both automatically when you use our Services and when you voluntarily provide such information. Generally, you control the amount and type of information you voluntarily provide to us when using our Services. For clarity, you must provide us with certain PII, including your name, email address, and phone number, in order to make a request for particular resources, additional information, or otherwise communicate with us via the Services. We will offer you choices when we ask for PII, whenever reasonably possible. You are not required to provide us with any PII when you are just visiting the Services. Not withstanding any of your rights and obligations under applicable law, as further discussed in Your Rights and Options Regarding Your Personally Identifiable Information below, we will, for all Users, make good faith efforts to provide you access to your PII upon request and to correct such data if it is inaccurate and delete it, when reasonably possible.

      In addition, we may also collect or receive PII about you from third parties in connection with our Services, including from the following sources:

      • Service providers (including hosting providers)

      • Third-party data providers
      • Email, chat, and other communications service providers
      • Our customers, including healthcare providers and pharmacies (with such customers providing information to ParcelShield including with respect to our customer’s own customers, referred to herein as their “end customers”)

      c. Computer Information Collected

      When you use our Services, we automatically collect certain computer information by the interaction of your mobile phone or web browser with our Services. This can be Personally Identifiable Information or Non-Personal Information that is collected about you when you are using the Services, and may include:

      • Information about your interactions with our Services, which includes the date and time of any information you enter into our Services.
      • User content you post to our Services including messages you send and/or receive through our Services and your interactions with our customer service team.
      • Technical data, which may include URL information, Cookie data, web beacons and other tracking technology information, your IP address, the types of devices you are using to access or connect to our Services, unique device IDs, device attributes, network connection type (e.g., Wi-Fi, 3G, LTE, Bluetooth) and provider, network and device performance, browser type, language, and operating system.

      Further details about the technical data that is processed by us can be found below.

      i. Cookies and Other Tracking Technologies

      Our Services use “Cookies.” Cookies are small data files that are downloaded onto your computer or mobile device when you use the Services, which are unique to your device. Your web browser stores Cookies in a manner associated with each website you visit. We or our third-party partners may use Cookies to recognize your web browser and tell us how and when you visit the Services, and to identify the areas of our Services that you have visited. Cookies help us learn which areas of the Website are useful and which areas need improvement. We also use Cookies and other technologies to enhance your online experience by eliminating the need to register multiple times for registration-required content. Finally, we may use Cookies to personalize the content that you see on our Services.

      Cookies may be either persistent or temporary (or session) Cookies. A persistent Cookie retains user preferences for a particular website, app or service, allowing those preferences to be used in future use sessions and remains valid until its set expiry date (unless deleted by the user before the expiry date). A temporary Cookie, on the other hand, will expire at the end of the user session, when the web browser or app is closed.

      You can choose whether to accept Cookies by changing the settings on your browser or device, as discussed further in “Your Rights and Options Regarding Your Personal Information” below. If you would prefer not to receive cookies, you can alter the configuration of your browser to refuse cookies. If you choose to have your browser refuse cookies, it is possible that some features of the Services will not function properly when you view them. We never place PII in Cookies.

      ii. Pixels, web beacons

      We or our third-party partners may use invisible pixels or beacons on our Services to count how many users access or use certain pages, features or content. This information is collected and reported in the aggregate. We may use this information to improve our current Services offerings, and to develop new products or services.  We use all of this information to analyze trends among our users to help improve our Services. 

      iii. Analytics

      Our Services use Salesforce Pardot analytics, Datadog, and Google Analytics to collect information about the use of our Services and User interaction with our marketing campaigns. These analytics service providers collect information, such as how often Users visit our Services, what pages of our Services Users visit, what materials Users download from our Services, browsers utilized by Users, what marketing campaigns Users interact with, and what other websites any User used prior to coming to our Services. We use the information we get from these analytics service providers to improve our Services. We do not combine the information collected through the use of analytics applications with PII. 

      iv. Social Media

      You can choose to limit the data that third-party services (e.g., social media platforms) disclose to us using the options provided to you by the applicable third-party service (for example, the options provided by a social media platform when you connect your social media account with our Services).  You can also disconnect your use of our Services from the third-party service at any time using the options provided to you by the applicable third-party service.  Please note, however, that if you disconnect from the third-party service, that will not delete the data we may have previously collected while you were connected.

      3. HOW WE USE PERSONALLY IDENTIFIABLE INFORMATION THAT WE COLLECT

      The information we gather enables us to provide the Services to you and personalize, improve, and continue to operate the Services. We will only use your information for the purposes identified below, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose, as further described in the chart below:

      a. Providing Requested Materials and Services

      We may use PII to provide the materials and services you’ve requested, and to fulfill the purposes for which the information was provided (e.g., to provide a service or perform on a contract). We may use PII to communicate with you about technical issues, new materials and services, and other information of interest to you. We may use PII to notify you about changes to our Services, or materials and other product or service offerings. We use PII to allow you to participate in interactive features of our Services when you choose to do so.

      b . Providing and Improving Our Services

      We may use the PII you provide to us, along with any computer information we receive, to provide our Services to you as well as to design, administer, and improve our Services. We may also use PII for auditing, research and analysis to operate and improve our materials and services. We use PII to gather analysis and assess trends and interests, to monitor usage of our Services, including by measuring user interaction with our Services so we can improve the relevancy or effectiveness of our content and messaging and to carry out marketing, advertising, and analytics.

      We may also use PII to detect, prevent, and address technical issues, to monitor for fraudulent or illegal activity, and to enable security measures (such as, to protect our Services, customers, employees, and business partners), and to identify and repair errors in the Services.

      c. Communications and Email Alerts

      When we communicate with you about our Services, we will use the email address you provided when registering, requesting information or materials from the Services, or signing up for an email communications list. We may use your PII to identify you in order to respond to requests, provide services or products, to communicate with you about your account or our relationship. We may also send you Services alerts regarding your use of our Services. Finally, we may also send you emails with promotional information about our Services or offers from ParcelShield or our affiliates, unless you have opted out of receiving such information. You can change contact preferences at any time through your account. You can opt-out of promotional messages, and you also can opt-out of receiving Services alerts.

      4. DISCLOSING YOUR INFORMATION

      We do not sell or rent your Personally Identifiable Information to third parties in exchange for money and we will not do so. ParcelShield does not sell or share the PII of minors under 16 years of age and has no actual knowledge of any such sales or disclosures. However, we may disclose Non-Personal Information with third parties at our discretion, including use of NPI for data aggregation purposes which might be sold to other parties at our discretion. Any such data aggregation would not contain any of your PII.

      a. Disclosures for a Business Purpose

      In connection with our Services, we may provide your PII to certain third parties and service providers who we engage to help us run our business and perform the services. Such affiliates and service providers will only receive information necessary to provide the Services, including under the following circumstances:

      • Service Providers we use to operate our Services and infrastructure, including web hosting providers and payment processors.
      • Marketing service providers we use to communicate with you.
      • Advertising service providers we use to assist us in providing personalized advertising.
      • Web analytics providers who monitor and analyze the use of our Services (including, as mentioned above, Google Analytics and Salesforce Pardot). We will disclose your PII to create general data analytics regarding usage of our Services on an aggregate basis and without personal identifiers.

      b. Disclosures for Our or Your Protection; Legally Required Releases of Information

      We will disclose your PII to third parties if such disclosure is necessary to: (a) comply with a subpoena, applicable law, regulation, or other legal process or governmental request; (b) assist law enforcement officials or government enforcement agencies; (c) investigate or prevent fraud, abusive or unlawful uses or activities, violations of our Terms of Service governing use of our Services and services and/or any law, rule, or regulation; (d) protect us from legal action or claims from third parties including you and/or other users; (e) protect the security or integrity of our Services and services; and/or (f) protect the legal rights, personal/real property, or personal safety of our company, our users, employees, and affiliates. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.

      c. Disclosures In the Event of a Business Transfer

      If our business is acquired or merges, in whole or in part, with another company that would become responsible for providing the Services to you, we may disclose information with the other business in connection with the transaction, and your PII may be transferred to the new business upon completion of the transaction. The new business would retain the right to use your PII according to the terms of this Privacy Policy.

      d. PII We Sell or Disclose for Targeted Advertising

      In addition to performing our own analytics and targeting content and advertisements on our Services and elsewhere online, we may work with third-party network advertisers, ad agencies, analytics service providers, and other vendors to provide us with such information and services. These service providers may set and access their own tracking technologies on your device (including Cookies and web beacons) and may otherwise collect or have access to information about you. Some of these parties may collect PII over time when you visit the Services or other online websites and services. We may disclose de-identified data (including Non-Personal Information) about visitors with third-party advertising companies, analytics providers, and other vendors for analytics and advertising purposes.

      5 . HOW LONG WE RETAIN YOUR PERSONALLY IDENTIFIABLE INFORMATION

      We will retain and use your Personally Identifiable Information to the extent necessary to comply with our legal, accounting, or reporting obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. Generally, ParcelShield will not retain any PII for longer than ten (10) years, unless otherwise required by applicable law. We will also retain and use your PII for as long as you use the Services and/or as necessary to provide the Services (for example, if you are a registered user of the Services, we will retain your PII for the entire duration of the business relationship). Additionally, we may continue to store your PII contained in our standard back-ups.

      We will also retain Non-Personal Information for internal analysis purposes. NPI is generally retained for a shorter period of time, except when NPI is used to strengthen the security or to improve the functionality of the Services, or we are legally obligated to retain NPI for longer periods.

      6. YOUR RIGHTS AND OPTIONS REGARDING YOUR PERSONALLY IDENTIFIABLE INFORMATION

      If you need assistance with updating your Personally Identifiable Information or removing yourself from our mailing lists, send us an email (at [email protected]) with your request, or contact us using any of the methods provided on our Services or listed under “How to Contact Us” above. 

      a. Marketing Preferences

      You have choices about how we use your PII to communicate with you, send you marketing information, and whether you want to stay signed into your account. By providing your telephone number and/or email address to us, you consent to receive phone calls and/or emails from or on behalf of ParcelShield and/or our partners and suppliers, including automated marketing messages sent via email. If you would like to opt out of marketing-related email communications from us, you can use the unsubscribe link found at the bottom of the email, or by contacting us as set forth in “How to Contact Us” above. If you later opt back into getting marketing communications from us, we will remove your information from our opt-out databases.

      b. Personalized Advertising

      If you do not wish to participate in our advertising personalization programs, you can opt-out by following the directions provided within the applicable advertisement, or through disabling ad cookies through your browser settings. You may also opt out of how companies unaffiliated with us use tracking tools and collect your information while visiting our websites by visiting each of their privacy policies and following instructions there. Generally, you can opt-out of the collection of data across unaffiliated sites over time for interest-based advertising and other purposes from companies participating in the Digital Advertising Alliance (DAA) Consumer Choice Page at www.aboutads.info/choices and from members of the Network Advertising Initiative (NAI) at www.networkadvertising.org/choices.  You also may opt out of receiving interest-based ads from Amazon, Facebook and Google. You will continue to see ads on each platform, but they will not be personalized as a result of your actions on our website. Please visit the links below if you wish to opt out or update your preferences.

      Please note that we and other companies may still collect information when you are online, and opting out through these mechanisms does not opt you out of being served advertising. You will continue to be served generic ads while online.

      c. Cookies; “Do Not Track” Settings

      As noted above in “Computer Information Collected” above, you can choose whether to accept Cookies by changing the settings on your browser or device. If you choose to disable Cookies, your experience with the Services may be impaired and some features may not work as they were intended.

      Additionally, some web browsers have “Do Not Track” settings that enable you to request that our Services does not track your movement within our Services. However, these features are not yet uniform, so we do not currently respond to such settings when transmitted to and detected by our Services. Therefore, if you opt to activate your browser’s “do not track” feature in your web browser, we and our third-party providers may continue collecting information about your online activities as described in this Privacy Policy. This does not change our compliance in any other way with our Privacy Policy. You may opt to activate your browser’s do not track settings.

      7. OTHER WEBSITES

      The Services may contain links to other websites. This Privacy Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third-party websites, services and applications that are linked or made available on our Services (“Third Party Services”). You understand that these websites are not under our control and are not subject to our Privacy Policy, and you should exercise caution when deciding to disclose any Personally Identifiable Information through those Third-Party Services. These websites will likely have their own privacy policies, and you should read the privacy policies of third-party websites carefully. By providing a link to a Third-Party Service, we are not endorsing or attempting to associate with any other entity, their content or services, or the persons or entities associated with those other websites. We have no responsibility for these Third-Party Services and provide links to these third-party websites solely for your convenience. We are not responsible for the content, privacy policies, actions, or security of any Third-Party Service. You also agree and acknowledge that ParcelShield will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, services, resources or goods on or through any such Third-Party Service. You acknowledge that your use and access of these other websites is solely at your own risk.

      8. TRANSFER OF DATA; SPECIAL NOTICE TO NON-U.S. USERS

      Your information, including Personally Identifiable Information, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including PII, to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

      We will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your PII will take place to an organization or a country unless there are adequate controls in place including the security of your data and other PII.

      If you are located in a country outside the U.S. and submit PII to us, you consent to the general use and disclosure of such information as provided in this Privacy Policy and to the transfer and/or storage of that information to the U.S. and other countries outside your home country.

      9. SENSITIVE PERSONAL INFORMATION

      We ask that you not send us, and you not disclose, any sensitive personal information as this term is defined under applicable data protection and privacy laws (for example, social security numbers, driver’s license, financial account login, debit or credit card number in combination with any required security or access code, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Services or otherwise to us.

      If you send or disclose any sensitive personal information to us, we will delete any and all such sensitive personal information. You must not submit such content to our Services.

      10. POLICY ON CHILDREN’S INFORMATION

      The Services are not intended for use by anyone under the age of 18, particularly children under the age of 13 (“Children” or “Child”). By using the Services, you represent that you are at least 13. If you do not meet this age requirement, please do not access or use the Services. We do not knowingly collect Personally Identifiable Information from Children, and we do not target the Services to Children. For more information about the Children’s Online Privacy Protection Act (COPPA), which applies to websites that direct their services to Children, please visit the Federal Trade Commission’s website https://www.ftc.gov/tips-advice/business-center/guidance/complying-coppa-frequently-asked-questions.  You acknowledge that we do not verify the age of our visitors and not have any liability to do so.

      If you are a parent or guardian and you are aware that your Child has provided us with PII, please contact us at any of the methods set forth under “How to Contact Us” above. We may ask for proof of identification before we remove any information to prevent malicious removal of account information. If we discover on our own that we have collected PII from a Child without verification of parental consent, we will delete the information as soon as we discover it, we will not use the information for any purpose, and we will not disclose the information to third parties. If you are a Child, please seek the permission of a parent or guardian before accessing our Services.

      11. OUR EMAIL POLICY

      We comply with the federal Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act). You can always opt out of receipt of further email correspondence and marketing campaigns from ParcelShield or our affiliates.       Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your PII. Please understand that we are required to verify your request and may require you to provide some information to enable us to carry out such verification. To verify that an authorized agent has authority to act for you, we may require a copy of a power of attorney or require that you provide the authorized agent with written permission and verify your own identity with us. We will deny requests from agents that do not submit proof of authorization from you. We cannot respond to your request or provide you with PII if we cannot verify your identity or authority to make the request and confirm the PII relates to you.

      When you, or someone legally authorized to act on your behalf, make a consumer request related to your PII, you can expect the following:

      1. We will verify your identity. You will need to provide us with certain information so that we can verify that you are who you say you are. Which information may depend on the type and sensitivity of information subject to the request.
      2. We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed above.
      3. We will respond to your request within the legally required amount of time. If necessary, we may need additional time to respond where allowed by law, but we will reply either way within the legally required period and, if we need an extension, we will explain why.

      As stated above, the CPRA also gives California residents the right to request that businesses opt them out of the sale or sharing of their PII. Like most websites, our websites use cookies and other technologies to interact with third parties and service providers for things like website analytics and advertising. Some of this website interaction with third parties is viewed as a “sale” under the CCPA AND CPRA and you can opt-out of that selling or sharing of PII.

      This Privacy Policy and all matters arising out of or relating to this Privacy Policy shall be governed by and construed in accordance with the laws of the State of Florida, except for its conflict of law provisions, which shall not apply. Exclusive jurisdiction and venue shall lie in the state and federal courts located in Orlando, Florida.
